By using the FitMVMT platform (operated by Wise Wave LLC, a Wyoming limited liability company) to find trainers and book sessions, you agree to these Terms of Service. Please read them carefully before using the platform.

1. Service Overview

FitMVMT is a marketplace that connects individuals with independent fitness trainers. We provide tools to help users discover, book, and review trainers. FitMVMT does not employ, supervise, or control the trainers listed on our platform. Trainers operate independently and are not employees, agents, or representatives of FitMVMT.

2. User Responsibilities

• Trainer Verification: Trainers on FitMVMT are not background-checked or certified by us. Users are responsible for performing their own due diligence prior to booking.
• Assumption of Risk: Physical training can involve serious risk, including injury or medical complications. By booking through FitMVMT, you accept all responsibility for your participation and assume any risks involved.
• Age Requirement: You must be 18 or older to use this platform.

3. Disclaimers

• No Warranties: FitMVMT makes no guarantees regarding the accuracy, quality, safety, or legality of trainer services. All services are used at your own risk.
• No Endorsement: Listing a trainer on our platform does not constitute an endorsement or verification by FitMVMT.
• Third-Party Services: FitMVMT integrates with third-party providers like Stripe. We are not liable for issues arising from their use.

4. Limitation of Liability

To the maximum extent permitted by law:

• FitMVMT shall not be liable for any injuries, damages, losses, or claims resulting from use of the platform or sessions booked through it.
• We are not responsible for user or trainer conduct, including negligence, misrepresentation, or unlawful behavior.
• FitMVMT shall not be held liable for lost data, revenue, or any indirect or consequential damages.

5. Indemnification

You agree to indemnify, defend, and hold harmless FitMVMT, its owners, employees, affiliates, and agents from any claims or liabilities arising from:

• Your use of the platform
• Your interactions with trainers or other users
• Any violation of these Terms

6. Cancellation and Refunds

Cancellations or changes to bookings are not permitted within 24 hours of the scheduled session start time. At the 24-hour mark, your payment method will be charged and no refunds will be issued. If you book a session less than 24 hours before its start time, payment will be processed immediately and no refunds will be issued.

7. Governing Law & Disputes

These Terms are governed by the laws of the United States and the State of Wyoming and are entered into by Wise Wave LLC, the owner and operator of the FitMVMT platform, without regard to its conflict of law rules. Any legal disputes shall be resolved exclusively in the courts located in the State of Wyoming. By using the platform, you waive your right to participate in class actions.

8. Changes to Terms

FitMVMT may update these Terms at any time. Users will be notified of material changes. Continued use of the platform constitutes your acceptance of the updated Terms.

• Trainer & Client Profile Data: biography, specialties, gym affiliations, availability, reviews
• Booking Information: session details, trainer/client interactions, cancellations
• Payment Information: billing details, payment method, Stripe account ID (processed by Stripe, not stored by us)
• Technical Data: IP address, browser type, device info, operating system, referral source
• Usage Data: time on site, pages visited, clicks, error logs

2. How We Use Your Information

• Create and manage user and trainer accounts
• Facilitate bookings and payments
• Communicate important session updates
• Provide customer support
• Improve our platform, content, and user experience
• Comply with legal obligations

We do not sell your personal data.

3. Sharing Your Information

• Trainers or clients you book sessions with
• Payment processors (e.g., Stripe) for secure transactions
• Service providers (e.g., cloud hosting, email providers, analytics tools)
• Legal authorities if required by law

We only share what’s necessary and never sell or lease your data to third parties.

4. Payment Processing

We use Stripe to handle payments and payouts. Stripe may collect and process personal and financial data. FitMVMT does not store credit card numbers.

7. Governing Law & Disputes

This Policy is governed by the laws of the United States and the State of Wyoming and is entered into by Wise Wave LLC, without regard to conflict of law principles. Any disputes arising out of or relating to your use of FitMVMT shall be resolved exclusively in the state or federal courts located in Wyoming. You waive any right to participate in a class action lawsuit or class-wide arbitration.
